Supreme Court Disposes of Human Rights Case

Islamabad: The Hon’ble Chief Justice of Pakistan Mr. Justice Iftikhar Muhammad Chaudhry took notice on a resolution passed by District Bar Association, Shaheed Benazir Abad. Through the said resolution bar stated that investigation agency is not cooperating for arrest of the nominated accused who are involved in the brutal murder of Ali Muhammad Dahri, Advocate. The Bar further stated that the legal heirs of the deceased advocate have lost confidence over the investigation team who is investigating the matter. The Bar unanimously requested the Hon’ble Chief Justice of Pakistan for justice.

Taking the notice, the HCJP ordered as following:-

“Report be called from PPO Sindh with regard to murder of Ali Muhammad Dahri Advocate within 07 days.”

In compliance with the above directions, the PPO Sindh submitted his report which reflects that investigation of the case crime No. 92/2011 u/s 302, 324, 337-H(ii), 427 PPC of PS “A” Nawabshah was carried out by SIP who after receiving permission from Home Department, Sindh and permission letter of Home Department Balochistan have proceeded to Hub Chowki Balochistan for arrest of remaining four (04) absconder accused persons and raided over their houses but could not succeed. On 11.07.2011, SIP submitted final challan before the concerned court of law showing remaining accused as absconders. The SIP assured the court that sincere efforts are continue for the arrest of accused and recovery of crime weapons.

After going through the report of PPO Sindh, the Hon’ble Chief Justice of Pakistan disposed the instant application with the following order:-

“PPO Sindh may be directed to ensure arrest of absconding accused and finalization of investigation and submission of final report u/s 173 Cr.P.C in the Court under intimation to this Court”
