Nandipur power project: Supreme Court directs Registrar to arrange inspection of the record maintained by the Commission

Islamabad, June 24, 2013 (PPI-OT): A three member bench, headed by Hon’ble. Mr. Justice Iftikhar Muhammad Chaudhry, Chief Justice of Pakistan and comprising on other two Judges, Hon’ble Mr. Justice Ijaz Ahmed Chaudhry and Hon’ble Mr. Justice Iqbal Hameedur Rehman heard the CONSTITUTION PETITION NO. 67 OF 2013 AND C.M.A. NO. 1656 OF 2012. The bench heard the case on 21.6.2013 and bench passed the following order:-


“Dr. Babar Awan, former Law Minister has filed an application (CMA No.3983/2013), which according to him raises preliminary issues in respect of processing of the project of the Nandipur, however, he needs to go through the record maintained by Mr. Justice (R) Rehmat Hussain Jaffri, who was appointed as one man Commission and the record maintained in the Law Ministry. It may be noted that the report of the Commission has already been made public, therefore, request so made to examine the record is allowed and the Registrar of this Court is directed to arrange inspection of the record maintained by he Commission according to the rules.

However, it would be appropriate if Dr. Babar Awan or any other among the respondents is interested to go through the record they may also approach to the Registrar and with consent of all of them, a date is fixed convenient to them for inspection of the report to save their time. As far as request to inspect the record of the Ministry of Law is concerned, we enquired from Mr. Muhammad Munir Peracha, learned counsel for the Ministry of Law, who stated that he needs some time to take instructions from the Secretary. Request is allowed. He may file his reservations, if any, on the next date of hearing.

2. Mian Asrar ul Haq, learned ASC, has sent an application for adjournment on the ground of his indisposition. Dr. Rana M. Shamim, learned ASC also requests for time to file reply on behalf of Agha Rafiq Ahmed, former Law Secretary and incumbent Chief Justice of the Federal Shariat Court . Mr. Justice (R) Riaz Kiani also requests for time to file reply. Requests so made are allowed.

3. Adjourned to a date in office after one week.”
