Machil fake encounter: Mirwaiz says involved troops should be tried in civil court

Srinagar, December 28, 2013 (PPI-OT): In occupied Kashmir, the Chairman of All Parties Hurriyet Conference, Mirwaiz Umar Farooq, has demanded that the Indian army personnel involved in Machil fake encounter should be tried in civil court instead of court martial proceedings.

The APHC Chairman addressing a gathering in Shangus area of Islamabad district said that the military court lacked credibility and therefore the army men involved in the staged encounter in which three innocent civilians were killed should be tried in a civil court. “How can the trial conducted by Army, whose forces are the perpetrators of the crime, be transparent?” he questioned.

The Mirwaiz said that apart from Machil, there were thousands of such cases of grave human rights violations committed by the Indian armed forces in the territory and it was high time to initiate action in all of them. He said that the black laws like Armed Forces Special Powers Act that gave impunity to the armed forces should be revoked.

The Indian Army has ordered court martial against six troops including a Colonel and a Major for killing three youth in fake encounter that took place in Machil area of Kupwara district in 2010.

The APHC Chairman castigated New Delhi for prolonging resolution of the Kashmir dispute. “Delhi wants to delay resolution of Kashmir issue but they can’t shy away from solving it. Resolution of Kashmir is imperative for peace in South Asia. Even the international community fully acknowledges this. India’s close ally, Russia, also accepts this reality,” he stated.

The Mirwaiz maintained that India could not hold Kashmir through military might because the sentiment of Azadi was inborn among the Kashmiris. “Kashmiris have offered countless sacrifices for the freedom movement. More than 10,000 people have been subjected to enforced disappearance, 6,000 people are buried in unmarked graves, over 80,000 people have been killed while thousands have been subjected to torture and detentions. I salute the resolve of Kashmiris,” he added.

The APHC Chairman said that dialogue was essential for settlement of the lingering dispute, adding, “We are not against dialogue because it is the only way to resolve Kashmir. India and Pakistan need to initiate serious dialogue and involve Kashmiris for resolving this long-pending dispute.”
