Implementation of Judgements of Honourable Supreme Court of Pakistan in Crl Org 89/2011 (2013 SCMR 1752) and CRP 193/2013(2015 SCRM 456)

Islamabad, October 01, 2016 (PPI-OT):On receipt of judgments on the subject, NAB had processed the case for implementation. However, in consultation with its Prosecution Division, a considered response was sent to Establishment Division that since the judgments primarily related to Civil Servants and NAB employees are not Civil Servants, Establishment Division was to streamline the structure of civil service and compliance by NAB (being government servants) would be undertaken thereafter.

The Honourable Apex court has held during hearing of Suo Moto case No.13/2016 That in view of para 121 of 2015 SCRM 456, it also applies on NAB. Attorney General of Pakistan has also raised some legal questions vide letter bearing F. No. AAGP-1(3)/2016, dated 23rd September, 2016.

The matter being of technical nature and to implement the directions of Honourable Supreme Court of Pakistan in the most appropriate manner, the Chairman NAB in consultation with Prosecutor General NAB has been pleased to constitute the following Committee to examine the appointments, deputations, adsorptions and promotions in NAB since 1999:

i. The Deputy Chairman, NAB *In Chair*

ii. The Additional Secretary Establishment Division *Member*

(To be nominated by Secretary Establishment)

iii. The Additional Secretary/Joint Secretary Law and Justice Division *Member*

(To be nominated by Secretary Law and Justice Division)

iv. The Director General (HRM), NAB HQ *Convener*

The above mentioned committee will examine each NAB officer’s case of initial recruitment, deputation, absorption and promotion in accordance with the principles laid down in the two judgments i.e. Crl Org 89/2011 (2013 SCMR 1752) and CRP 193/2013 (2015 SCMR 456) and will make suitable recommendations regarding eligibility of the officer concerned at the time of absorption/ recruitment/ promotion, as the case may be. The committee will submit its report within ten days.
